Question

What legalities/essential terms should I be aware of prior to submitting a software or domain purchase request?

Answer

As a state of Ohio public university, BGSU is required to review potentially problematic essential terms of all new software and domain contracts. The amount of time required for a contract to be reviewed and addendum's negotiated (if necessary) can be lengthy. As a result, ITS advises submitting all new software or domain purchase requests well in advance of the date needed. 

More information related to state and federal law regarding these essential terms can be found on the Ohio Attorney General’s website. In addition to these requirements, the Office of the General Counsel may also require specific terms review (see the General Counsel 3341-1-7 Delegation of Contract and Signatory Authority policy).

If the vendor is unwilling to make the necessary modifications to the software/domain agreements, policies, or contracts to adhere to these essential terms, your purchase request may be denied.
